Public domain This work is from the Carl Van Vechten Photographs collection at the Library of Congress. According to the library, there are no known copyright restrictions on the use of this work.
As the restrictions on this collection expired in 1986, the Library of Congress believes this image is in the public domain. However, the Carl Van Vechten estate has asked that use of Van Vechten's photographs "preserve the integrity" of his work, i.e, that photographs not be colorized or cropped, and that proper credit is given to the photographer.

Image taken from this page at the Library of Congress website, with the following notation at this page: "The instrument of gift for this collection states that "for a period of 20 years from the date of this Instrument [1966], none of the photographs contained in said collection may be sold, reproduced, published or given away in any form whatsoever except with my [Saul Mauriber, Photographic Executor for Van Vechten] express permission in writing." This restriction expired in 1986. However, given the variety of persons whose portraits were made by Van Vechten, privacy and publicity rights may apply." I believe Desmond's privacy rights in this case were waived long ago when he became famous; I believe Desmond's publicity rights are similarly irrelevant, as wikipedia is not using this image for commercial exploitation.

I made a slight crop of the image to rid it of the black border; if such a crop constitutes "creative input" and qualifies the new image for copyright protection, then I explicitly disclaim any and all copyright on the image. Koyaanis Qatsi 03:38 13 Jul 2003 (UTC)
